1. Welcome to AgriVesta
AgriVesta is a Kenya-based online marketplace that connects farmers with buyers of agricultural produce, and that enables the buying, selling and hire of farm inputs and equipment. By creating an account or using the platform, you agree to these Terms of Service.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract under Kenyan law to use AgriVesta. You agree to provide accurate information when signing up and to keep it up to date.
3. Accounts: Farmer or Buyer
During signup you choose to register as a Farmer (selling produce or offering equipment) or a Buyer (purchasing or hiring). You are responsible for activity on your account and for keeping your password confidential.
4. Listings
Sellers are solely responsible for the accuracy of their listings, the quality and legality of the goods or services offered, and for fulfilling agreed orders. AgriVesta may remove listings that violate these Terms or applicable Kenyan law.
5. Payments & M-Pesa Escrow
All payments on AgriVesta flow through our M-Pesa escrow system. Buyer funds are held by AgriVesta until the buyer confirms successful delivery of the produce, input, or equipment. AgriVesta charges a commission of 10% on the value of every completed transaction, which is deducted before the seller is paid out.
6. Disputes
If a buyer reports a delivery or quality issue, the funds remain in escrow while AgriVesta investigates. Both parties agree to cooperate in good faith. AgriVesta's dispute resolution is binding unless either party pursues an alternative legal remedy under Kenyan law.
7. Prohibited Conduct
You agree not to: list illegal or counterfeit goods, engage in fraudulent transactions, attempt to bypass the escrow system, harass other users, or scrape or misuse the platform.
8. Limitation of Liability
AgriVesta is a marketplace facilitator. We do not own or inspect the goods sold and provide no warranty as to quality. To the maximum extent permitted by law, our liability is limited to commissions paid to AgriVesta in the 3 months preceding any claim.
9. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
